The international boundary runs through the lake, which is shared by the United States and Canada. He did not redraw the international boundary. He did not obtain Canada’s consent. He did not rename the lake for the world.

He ordered his own executive branch to use a different label.

That is the actual reach of this executive order—and no amount of Oval Office theater can make it larger.

The Limit: What Trump Cannot Do

Lake Ontario is an international body of water shared by the United States and Canada. Approximately 52 percent of its surface area lies on the Canadian side of the border, with the remainder adjoining New York.

Trump has broad authority to determine what federal agencies call geographic features. The U.S. Board on Geographic Names exists to standardize federal terminology, and its decisions are binding within the federal government.

But federal terminology is not international law.

Trump cannot order Canada to adopt the name. He cannot compel New York State to use it. He cannot force foreign governments, international organizations, private publishers, universities, news agencies, or the public to participate.

There is no single international authority with the power to impose one name on every country. Shared geographic features frequently carry different names in different nations.

In this case, however, Canada is not proposing a new name. Trump is attempting to replace a name that has endured for centuries.

Canadian Prime Minister Mark Carney responded that the lake will remain Lake Ontario “then, now and always.”

Ontario Premier Doug Ford said it would remain Lake Ontario to Canadians and the rest of the world.

New York Governor Kathy Hochul was even more direct: “New York won’t be calling it that.”

Trump may control the words appearing on federal maps. He does not control history, geography, or the English language.

The History He Is Trying to Erase

The name Ontario did not originate with the Canadian government.

It predates both the Canadian Confederation of 1867 and the American Declaration of Independence of 1776.

“Ontario” derives from the Wendat word Ontari’io. It has been translated as “the lake is beautiful, the lake is big,” “great lake,” or “lake of shining waters.”

European mapmakers were using Ontario as the lake’s name during the 17th century. The name appeared on maps of North America as early as the 1650s.

The lake did not take its name from the province. The province eventually took its name from the lake.

That history makes Trump’s action especially offensive.

Grand Chief Pierre Picard of the Wendat Nation condemned the order as an attempt to erase Wendat history. He was right to do so.

The White House described the change as honoring American heritage, yet the order replaces an Indigenous name with a slogan created to satisfy Donald Trump’s political branding.

That is not historical restoration.

It is historical appropriation.

The White House’s Case Does Not Establish Ownership

The executive order attempts to justify the change by emphasizing American investments, shipping interests, military history, and icebreaking operations on the Great Lakes.

It notes that the U.S. Coast Guard operates nine of the 11 icebreaking vessels serving the Great Lakes. It cites billions of dollars in American environmental investments. It also argues that because the deepest portion of Lake Ontario lies on the American side, the United States can claim most of the lake’s water volume.

Those facts do not produce the conclusion Trump wants.

Operating more icebreakers does not confer naming rights. Funding environmental restoration does not transfer sovereignty. Water depth does not move an international boundary.

The order’s financial comparison is also incomplete. It cites nearly $4 billion in U.S. Great Lakes restoration spending but does not provide a transparent, equivalent accounting of Canadian federal, provincial, municipal, infrastructure, environmental, and Coast Guard investments.

Cooperation between the two countries has never depended on each side spending precisely the same amount through identically structured programs.

The Great Lakes are protected and managed through more than a century of binational cooperation, including the 1909 Boundary Waters Treaty and the International Joint Commission.

That cooperative history—not Trump’s invented naming contest—is what has kept commerce moving, drinking water available, environmental restoration underway, and disputes from becoming international crises.

The Pattern

The important question is not whether “Lake America” sounds ridiculous.

It does.

The important question is why the president of the United States is devoting federal authority to a deliberately provocative stunt during a rapidly escalating trade conflict with America’s closest neighbor.

The answer is that Trump governs through domination, humiliation, and spectacle.

Since returning to office, he has repeatedly taunted Canada about becoming America’s 51st state. He has treated tariffs not simply as economic policy but as instruments of personal punishment. He has portrayed alliances as protection rackets in which other nations must demonstrate loyalty to him.

Now he is attempting to write that posture onto the map.

Trump used the same nationalist branding when he ordered the federal government to call the Gulf of Mexico the “Gulf of America.” He has attached his name or political identity to government buildings, programs, proposed warships, prescription-drug initiatives, investment accounts, and other symbols of public power.

During Thursday’s ceremony, he even suggested that the Atlantic or Pacific Ocean might be next.

That comment may sound like another offhand Trump boast. It should still be understood as part of the pattern.

Every absurdity creates a new loyalty test.

Will federal agencies obey?

Will media organizations repeat the new name?

Will elected Republicans pretend it is normal?

Will the public laugh, become exhausted, and move on before asking why taxpayer-funded institutions are being used to validate one man’s ego?

The spectacle is the mechanism.

Why This Matters

The United States and Canada are engaged in a serious trade conflict.

The Trump administration recently imposed 50 percent tariffs on approximately $20 billion in Canadian goods after negotiations collapsed. Canada responded with retaliatory tariffs on approximately $20 billion in American products, including steel, dairy products, appliances, and agricultural equipment.

Those tariffs have consequences for workers, farmers, manufacturers, businesses, and consumers on both sides of the border.

Instead of lowering tensions and negotiating responsibly, Trump turned a shared lake into another weapon of political humiliation.

That damages more than Canada’s feelings.

The United States and Canada cooperate on defense, intelligence, energy, trade, border security, environmental protection, transportation, shipping, and the management of shared waterways. The Great Lakes themselves are sustained through institutions built upon consultation and mutual responsibility.

Those relationships cannot be maintained indefinitely if one country’s president treats the other as an enemy to be mocked, economically punished, absorbed, or symbolically erased.

Seventy-two percent of Americans expressed a favorable view of Canada in a May Reuters/Ipsos poll.

Trump is manufacturing hostility toward a country the American people overwhelmingly regard as a friend.

The Constitutional Stakes

The most responsible criticism is also the most precise one.

This executive order is not automatically unconstitutional merely because it is arrogant, historically insulting, or diplomatically reckless. Presidents have considerable latitude over terminology used by executive-branch agencies.

The constitutional concern lies in the larger accumulation of power and behavior.

Trump repeatedly treats executive authority as an extension of his personal identity. Government agencies become instruments for rewarding loyalty, punishing opposition, controlling public language, rewriting history, and turning presidential preferences into official reality.

That is how democratic government becomes personalized.

The danger is not that Americans will suddenly forget the name Lake Ontario. The danger is that we become accustomed to a president using public institutions to satisfy private resentments—and that each new abuse seems less alarming because the previous one was allowed to stand.

As an Air Force veteran and an educator, I do not confuse loudness with strength.

Real national strength requires discipline, historical understanding, credible alliances, and respect for the limits of power. Picking a fight with Canada over the name of a shared lake demonstrates none of those qualities.

It is not patriotism.

It is insecurity wrapped in a flag.

How We Fight Back

First, call the lake by its name: Lake Ontario.

Second, explain accurately what the order does and does not accomplish. Do not exaggerate Trump’s authority by pretending he has renamed the lake for Canada or the world.

Third, refuse to let the comedy obscure the consequences. The same administration staging a map stunt is escalating a trade war that can raise prices, disrupt supply chains, damage American agriculture, and threaten manufacturing jobs.

Fourth, defend the Indigenous history Trump’s order attempts to push aside. The name Ontario is not foreign to America. It comes from a North American people whose history long predates the United States.

Fifth, demand that Congress conduct oversight of the money, staff time, map revisions, database changes, contract updates, signage, and administrative work required to carry out politically motivated renaming campaigns.

Finally, remember that ridicule alone is not resistance. Authoritarian politics often arrives surrounded by absurdity because absurdity leaves the public uncertain about whether to laugh or sound the alarm.

We can do both.

We can recognize that “Lake America” is ridiculous while also recognizing what it represents.

The Line We Draw

Donald Trump can order federal employees to type “Lake America” into a government database.

He cannot make Canada surrender its history.

He cannot move the international border.

He cannot erase the Wendat origin of the name.

He cannot force New York to cooperate.

He cannot transform political theater into geographic truth.

And he cannot make the rest of us surrender our obligation to call things what they are.

It was Lake Ontario before Donald Trump entered politics.

It is Lake Ontario today.

It will remain Lake Ontario long after his executive order is remembered as one more embarrassing artifact of an administration that mistook presidential power for personal ownership.

That is the line we draw: no president owns our institutions, our history, our alliances, our language—or reality itself.

If this analysis helped cut through the spectacle, please restack it so more readers can understand what Trump’s order actually does, what it cannot do, and why the distinction matters.

P.S. impeachment of President Donald Trump and Vice President JD Vance. He now faces ten specifications under three articles of the Uniform Code of Military Justice. If his case reaches a general court-martial and ends in conviction, he could lose his commission, his pay, his freedom, and the military retirement for which he has spent 17 years working.

This Substack is reader-supported. I also learned that our oath is to the Constitution—not to a president, a party, or a personality. Those principles can exist in tension. Serious people must be capable of defending both.

Maj. Jason Watson should not be turned into a flawless hero. Appearing at a political demonstration in uniform was a reckless decision. If the allegations are accurate, he also violated leave rules, disobeyed orders, and refused to wear his uniform when directed to report for duty. The Air Force has a legitimate interest in addressing that conduct.

But tactical bad judgment is not a blank check for constitutional abuse. The most consequential part of this case is not what Watson wore. It is the government’s decision to prosecute what he said.

That is where this becomes bigger than one major, one protest, or one president.

[Suggested paywall placement]

What Watson Is Actually Accused Of

According to reporting by Military.com, Reuters, and Stars and Stripes, charges were preferred against Watson under three UCMJ articles:

Three specifications under Article 88, contempt toward officials

Five specifications under Article 92, failure to obey an order or regulation or dereliction of duty

Two specifications under Article 133, conduct unbecoming an officer

“Preferral” means that charges have been formally sworn. It does not mean they have been referred to trial, and it certainly does not mean Watson has been convicted. The charges remain allegations, and he is entitled to the presumption of innocence and military due process.

The Article 88 allegations reportedly arise from three public episodes: a June interview with the Defenders of Our Republic Substack, his July 1 appearance in uniform on the Capitol steps, and an August 17 CNN interview. During the latter, Watson accused Trump of violating the Constitution and the law, engaging in corruption, and causing American deaths.

The Article 92 allegations are more conduct-based. They reportedly include violating restrictions on partisan political activity, improperly wearing his uniform at a political event, traveling to Washington in violation of leave rules, and later refusing an order to wear his uniform at work. The Article 133 specifications reportedly concern his Capitol appearance and CNN interview.

That separation matters. The government may have a strong case that Watson violated neutral rules governing uniforms, leave, duty status, and obedience. It does not automatically follow that his political criticism was criminal contempt.

Article 88 Is Not a General Ban on Criticizing a President

Article 88 applies only to commissioned officers. It prohibits “contemptuous words” against the president, vice president, Congress, the defense secretary, the service secretaries, the homeland security secretary, and certain state officials.

The government must establish that the accused was a commissioned officer, used words against a protected official, caused those words to become known to someone else, and that the words were contemptuous in themselves or in context.

The part too many headlines omit is the limiting language in the 2024 Manual for Courts-Martial. Emphatic adverse criticism made during political discussion may not be charged when it is not personally contemptuous. Private opinions ordinarily should not be charged either.

Article 88 is still an extraordinary law. The truth or falsity of the officer’s statement is legally immaterial. In other words, a statement can be factually accurate and still punishable if a military court finds it contemptuous. The maximum punishment for an Article 88 violation includes dismissal, forfeiture of all pay and allowances, and confinement for one year.

The crucial question is therefore not whether Watson criticized Trump. Military law expressly leaves room for criticism. The question is whether his language and the circumstances crossed the line from political condemnation into punishable personal contempt.

Calling a president a “failure” may sound insulting. Accusing a president of violating the Constitution and launching war without congressional authorization is also unmistakably a political and constitutional argument. And “Impeach. Convict. Remove.”—the message on Watson’s sign—is a demand that Congress use a lawful constitutional process. It is not a call for a military coup, violence, or refusal of a specific lawful order.

That does not resolve the legal issue. It explains why there is a real legal issue to resolve.

Watson Gave the Air Force a Conduct Case

The strongest argument against Watson is not Article 88. It is that he deliberately wrapped political dissent in the authority and imagery of his uniform.

The Defense Department’s own guidance permits active-duty members to express personal political opinions, but not as representatives of the armed forces. They may attend political events as spectators only when out of uniform. DoD Instruction 1325.06 also prohibits participation in certain off-post demonstrations, including when a service member is on duty, breaches law and order, or wears the uniform contrary to uniform regulations.

Watson apparently wanted the uniform to amplify his message. It did. It also made it easier for prosecutors to argue that the public could perceive official military endorsement of his position.

As a veteran, I would never advise an active-duty officer to take that route. The uniform belongs to the service and the country. It should not become campaign attire for either party.

Yet the Defense Department’s protest policy begins with another principle: a service member’s right of expression should be preserved to the maximum extent consistent with the Constitution, good order, discipline, and national security. The same policy states that criticism of government officials or policies is not, by itself, sufficient grounds to ban material.

The Air Force can enforce uniform and duty rules without transforming every harsh criticism of Donald Trump into criminal contempt. Article 92 can punish disobedient conduct. Article 88 should not become a convenient way to punish the viewpoint attached to it.

The History Shows Why Selective Enforcement Matters

Watson’s attorney says he is the first military major ever charged under Article 88. I have not found an independent official source proving that precise claim. I did find a history that makes it plausible—and exposes how unevenly this law has been used.

Henry Howe: Convicted for an Anti-Johnson Sign

In 1965, Army 2nd Lt. Henry Howe joined an anti-Vietnam War demonstration in El Paso while off duty and wearing civilian clothes. His signs denounced President Lyndon Johnson in personally contemptuous terms. Howe was convicted under Articles 88 and 133, and the military’s highest appellate court upheld the conviction in 1967.

Howe remains the foundational Article 88 case. It demonstrates just how far military jurisdiction can reach: off base, off duty, and out of uniform. It also comes from an era when courts gave the military sweeping latitude to restrict speech in the name of discipline.

Shane Sellers: A Major Who Called for Clinton’s Impeachment

The closest historical parallel may be Marine Maj. Shane Sellers. In 1998, Sellers wrote in Navy Times that President Bill Clinton was an “adulterous liar” and a criminal, and he argued that impeachment proceedings were warranted.

Sellers was the same rank as Watson. He used openly contemptuous language and advocated impeachment. Yet the Marine Corps did not court-martial him. According to an Associated Press report preserved by The Washington Post, he received verbal counseling and a nonpunitive letter of caution.

The cases are not identical. Sellers wrote a newspaper column; Watson protested in uniform and allegedly continued after being restricted and ordered to stop. Those differences may justify different treatment under Articles 92 and 133. They do not explain away the vast difference between a cautionary letter and pretrial confinement when both officers publicly urged a president’s impeachment.

Gary Stein: An Enlisted Marine Punished for Anti-Obama Speech

Article 88 did not apply to Marine Sgt. Gary Stein because he was enlisted. But in 2012, the Marine Corps administratively separated him with an other-than-honorable discharge after anti-Obama Facebook activity and statements about refusing presidential orders. Contemporary reporting described the case as a collision between military discipline and political speech.

Stein’s case shows that restrictions on partisan conduct have not been enforced only against the left. It also shows why precision matters. Criticizing policy is one thing. Publicly declaring that one will not follow orders is another—unless the speaker carefully distinguishes the military duty to refuse an unlawful order.

Stuart Scheller: Charged, Convicted—and Now Back in the Pentagon

After the chaotic 2021 withdrawal from Afghanistan, Marine Lt. Col. Stuart Scheller publicly attacked senior civilian and military leaders and continued after being ordered to stop. He spent time in pretrial confinement, was charged under Article 88 and five other UCMJ provisions, and pleaded guilty. His sentence included a reprimand and $5,000 in forfeited pay.

Scheller’s case initially looks like evidence of consistent enforcement. Then comes the political twist.

The current Pentagon now employs Stuart Scheller as deputy chief of staff to the under secretary responsible for personnel and readiness. The officer punished for publicly attacking leadership under President Biden has been welcomed back into government under President Trump, while Watson sits in confinement awaiting the disposition of charges for attacking Trump.

That contrast does not invalidate Watson’s charges. It does demolish any pretense that politics can be ignored when judging how dissent is punished, forgiven, or rewarded.

Mark Kelly: A Federal Court Draws a Line

The Trump administration also tried to censure and potentially reduce the retired rank and pay of Sen. Mark Kelly, a retired Navy captain, after he joined other lawmakers in reminding troops that they may refuse unlawful orders.

In February 2026, U.S. District Judge Richard Leon blocked that effort, finding that Kelly was likely to succeed on his First Amendment retaliation claim. The administration appealed, and a federal appellate panel later questioned the government’s position.

Kelly is retired and a sitting senator, so his constitutional protections are substantially different from Watson’s. Still, the episode reveals the same impulse: treating a reminder about constitutional and legal limits as disloyalty to the president.

Civilian Control Is Not Presidential Worship

Article 88 serves a legitimate democratic purpose. A republic cannot tolerate officers using military authority to intimidate elected leaders, mobilize troops for partisan objectives, or position the armed forces as an independent political power. The military must remain subordinate to civilian government.

But civilian control of the military does not mean personal submission to Donald Trump. The president is commander in chief; he is not the embodiment of the Constitution, and he is not beyond criticism.

Impeachment itself is a civilian constitutional remedy. Watson did not order troops to remove Trump. He called on Congress to act. However unwise his use of the uniform may have been, that difference is fundamental.

If Article 88 is enforced aggressively against officers who criticize Trump but leniently against officers who attacked Clinton or Biden-era leadership, it ceases to function as a neutral protection for civilian control. It begins to look like viewpoint enforcement: loyalty for one side, discipline for the other.

The danger is larger than Watson. Selective punishment teaches everyone in uniform a poisonous lesson—not “remain nonpartisan,” but “learn which politics the chain of command will tolerate.” That is how an apolitical military is slowly converted into a politically obedient one.

My Judgment as an Air Force Veteran

I do not stand at a cautious distance from Watson’s central conclusion. I agree with him 100 percent: Donald Trump should be impeached by the House, convicted by the Senate, and removed from office.

I believe Trump has repeatedly violated the Constitution, abused the powers of the presidency, and demonstrated that he is unfit to serve as commander in chief. Watson was right to call for Congress to use the constitutional remedy the founders provided for precisely such a crisis. On that fundamental question, there is no daylight between his position and mine.

My concern about Watson’s actions is tactical, not moral or constitutional. I would not have advised an active-duty officer to make a political demonstration in uniform, and he was not free to disregard lawful orders simply because he believed his cause was righteous. If the evidence proves violations of neutral duty, leave, or uniform regulations, the Air Force may address them through a fair and proportionate process. None of that makes his demand for Trump’s impeachment wrong.

Watson understood that he could lose his career, his retirement, and his freedom. He spoke anyway. I will not pretend to be neutral about the courage that required or the truth he was trying to force this country to confront.

I am therefore far more troubled by an Article 88 prosecution that risks making “contempt” synonymous with forceful opposition to Trump than I am by Watson’s call for impeachment. That concern becomes even more serious when the prosecution unfolds amid a broader campaign to punish disfavored military and veteran speech while rewarding politically useful dissenters.

Good order and discipline are indispensable. So are proportionality, consistency, and due process. An institution that demands accountability from a major must demand integrity from those deciding his fate.

Watson is presumed innocent. Preferral is not referral. Referral is not conviction. Pretrial confinement is not supposed to be punishment. The Air Force must prove every element of every offense and show that its treatment of him is grounded in military necessity—not presidential sensitivity.

What Happens Next

The charges will be reviewed to determine whether they should proceed to court-martial. If required, an Article 32 preliminary hearing will assess probable cause and make recommendations concerning disposition. A convening authority will then decide whether to refer charges to trial, dispose of them another way, or dismiss them.

The public should watch several questions:

What exact words support each Article 88 specification?

Which allegations concern neutral misconduct, and which concern political viewpoint?

What orders was Watson given, when were they issued, and were they lawful?

Why was continued pretrial confinement considered necessary?

How does the proposed disposition compare with Sellers, Scheller, and other political-speech cases?

Will the Air Force release enough information to allow meaningful public scrutiny without compromising Watson’s right to a fair trial?

Those are not anti-military questions. They are the questions of citizens who want military justice to remain worthy of its name.

Final Word

The uniform imposes obligations civilians do not carry. It demands restraint, discipline, and obedience to lawful orders. Maj. Jason Watson knew that and appears to have deliberately accepted the consequences of crossing several well-marked lines.

But the uniform is not a gag, Article 88 is not a presidential shield, and military justice must never become a partisan weapon.

Donald Trump is entitled to the obedience the Constitution gives the commander in chief. He is not entitled to personal reverence. No president is.

The Air Force can punish proven misconduct without criminalizing constitutional dissent. Whether it can still tell the difference may be the most important question in Jason Watson’s case.

How We Fight Back

We defend an apolitical military by applying the rules evenly—regardless of whether the president is a Democrat or Republican and regardless of whether we agree with the service member’s politics.

We insist on due process, transparent proceedings, and proportionate punishment. We separate uniform violations and disobedience from protected political criticism. We demand congressional oversight when military law appears to be used selectively. And we refuse the authoritarian lie that criticism of a president is betrayal of the country.

Most of all, we remember what every service member’s oath makes clear: loyalty to the Constitution is not disloyalty to America. It is the highest form of loyalty America asks.

Paid subscriptions support deeply sourced, independent analysis that refuses partisan propaganda, lazy false equivalence, and silence in the face of democratic erosion.

This Substack is reader-supported. constitutional arguments on their merits.

Instead, the majority concluded that the states challenging the executive order had not yet demonstrated the kind of concrete injury necessary to justify the particular injunction entered by the lower courts.

Translated out of legalese:

The states may have sued too soon.

And that is where this decision becomes so important.

Because election law has an unforgiving characteristic that most ordinary litigation does not:

There is a deadline.

November 3 is coming whether the courts are ready or not.

What Trump Is Trying to Change

Trump’s executive order directs federal agencies to become significantly more involved in election administration.

Among its provisions, the administration has sought greater federal involvement in verifying citizenship information and changing procedures involving mail ballots.

The U.S. Postal Service has also developed regulations connected to the administration’s effort.

And that matters because mail voting is no longer a peripheral feature of American elections.

Millions of Americans use it.

Military personnel use it.

Americans living overseas use it.

Elderly voters use it.

Disabled voters use it.

Working Americans who cannot easily reach polling places use it.

Entire states have developed election systems heavily dependent upon it.

So when Washington changes the rules governing ballot mail, election officials cannot simply flip a switch.

They have to change procedures, rewrite instructions, modify envelopes, update computer systems, train employees, educate voters, coordinate with postal officials—and do it all correctly.

Now Look at the Calendar

This may be the most important part of the story.

The November election is not some distant event awaiting us several months from now.

Election administration is already underway.

Ballot envelopes are being printed.

Military and overseas ballots will begin going out in some states within days.

Election officials are finalizing procedures that normally require months of preparation.

That means the legal question is no longer theoretical.

The Supreme Court has effectively told states that their earlier lawsuit may have been premature.

But if they wait too long to challenge the government’s actual implementation, another principle of election law can come into play:

Courts are traditionally reluctant to change election rules immediately before voting.

See the problem?

Sue too early: You may not have standing.

Sue too late: Courts may refuse to interfere with an election already underway.

That is the trap Jackson is describing.

And it ought to concern conservatives, liberals and everyone in between.

Justice Jackson Identified the Catch-22

Jackson’s dissent gets to the heart of what may become one of the most consequential election-law questions of 2026.

Federal courts require plaintiffs to demonstrate an actual or sufficiently imminent injury before they can sue.

That rule exists for good reason.

Courts should not issue advisory opinions about hypothetical disputes.

But elections operate differently from most government programs.

Imagine a state election official believes a new federal requirement is unconstitutional.

If she challenges it immediately, a court can say:

Nothing has happened yet.

If she waits until ballots have been redesigned and election procedures altered, a court can say:

Changing the rules now would create voter confusion.

Heads the government wins.

Tails the state loses.

That is the procedural nightmare Jackson is warning about.

And it becomes especially troubling when the dispute involves an election that will determine control of Congress.

There Is Another Constitutional Question Hiding Underneath All of This

Forget Trump for a moment.

Forget Democrats and Republicans.

Read the Constitution.

Article I, Section 4 provides that the “Times, Places and Manner” of congressional elections shall be prescribed in each state by its legislature, while giving Congress authority to alter those regulations.

Notice who is not expressly given that power.

The president.

That does not automatically mean every federal action affecting an election is unconstitutional.

Congress has given agencies—including the Postal Service—authority that can affect election administration.

The executive branch also has legitimate responsibility for enforcing federal law.

Those are the arguments the Trump administration will continue making.

But the underlying constitutional question is significant:

How far can a president go in directing federal agencies to alter election procedures that the Constitution primarily assigns to states and Congress?

Monday’s Supreme Court order did not answer that question.

Eventually, someone will have to.

And That Is Why Monday’s Decision May Actually Create More Litigation

Here is the irony.

The Supreme Court concluded that the states’ earlier challenge was premature.

But federal agencies are now moving further into implementation.

That makes the alleged injury increasingly concrete.

Which means states can return to court.

New plaintiffs can sue.

Different provisions can be challenged.

Postal regulations can face separate litigation.

District judges can issue new orders.

Appeals courts can review them.

And those cases can eventually arrive exactly where this one did:

Back at the Supreme Court.

Except next time the election will be even closer.

That is not stability.

That is a judicial countdown clock.

Why This Substack Page Matters

Most Americans will encounter this story as a headline:

SUPREME COURT SIDES WITH TRUMP ON MAIL BALLOTS.

Then the political machinery takes over.

One side celebrates.

The other side panics.

Everyone moves on to the next outrage.

But that headline does not tell you what actually happened.

The Court did not decide the constitutional question.

Another injunction remains.

Further litigation is almost certain.

Postal regulations matter.

Standing doctrine matters.

The election calendar matters.

And the distinction between winning a procedural ruling and winning the underlying constitutional case matters enormously.

That is what I want We the People United! to do differently.

Not simply tell you what happened.

Explain why it matters, what comes next, and what the headline leaves out.

If that kind of independent analysis is valuable to you, consider becoming a paid subscriber. Your subscription supports the research and writing necessary to go beyond the daily headlines and examine what these decisions actually mean for our democracy.

The Conservative Majority Does Have a Legal Argument

There is an argument for what the majority did, and it should not be ignored simply because one dislikes the outcome.

Federal courts are courts of actual cases and controversies.

They are not supposed to intervene every time a president issues an executive order that might eventually injure somebody.

If federal agencies have not yet completed their actions, courts ordinarily hesitate to decide disputes based upon speculation about what those agencies might ultimately do.

That is a legitimate judicial principle.

The difficulty is applying that principle to elections.

Because if courts insist upon waiting until injury becomes indisputable, election administrators may have very little time left to fix it.

That is the tension at the center of this case.

And Jackson believes the majority has placed too much of that risk on the states.

The Next Lawsuit May Be More Important Than This One

Watch what happens next.

The most important legal development may not be Monday’s Supreme Court ruling at all.

It may be the next challenge.

If federal agencies begin enforcing finalized requirements, states will have a much stronger argument that their injuries are no longer speculative.

That could move litigation away from procedural questions such as standing and toward the issue Americans really need answered:

Does the president actually have the authority to do this?

When that question finally reaches the Supreme Court, the stakes will be considerably higher.

Because then the justices may have to choose between two competing understandings of presidential power.

One gives the executive branch substantial latitude to use existing federal agencies and statutes to protect what it considers election integrity.

The other warns that allowing presidents to use executive authority to reshape election administration intrudes upon powers the Constitution deliberately gave elsewhere.

That decision could influence American elections long after Donald Trump is gone.

There Is a Democratic Principle Here That Should Not Be Partisan

Election rules should be known before elections.

That should not be controversial.

Republican voters deserve that certainty.

Democratic voters deserve it.

Independent voters deserve it.

Election workers deserve it.

Candidates deserve it.

And losing candidates should not be able to point to constantly changing rules as evidence that the system itself cannot be trusted.

One of the worst things government can do before an election is create ambiguity about how ballots will be cast, transmitted or counted.

Because distrust thrives in ambiguity.

And America already has more than enough distrust surrounding elections.

The Question Nobody Should Ignore

Imagine reversing the political parties.

Imagine a Democratic president issuing an executive order directing federal agencies to impose substantial new requirements affecting state election procedures shortly before congressional elections.

Would conservatives simply shrug and say presidential authority should be given the benefit of the doubt?

I doubt it.

And they shouldn’t.

Constitutional principles matter most when we apply them to presidents we support.

That is the test.

The question therefore should not be:

Do I trust Donald Trump?

Or:

Do I trust Democratic governors?

The question should be:

What power does the Constitution actually give a president over federal elections?

That answer should remain the same regardless of which party occupies the White House.

The Bottom Line

Justice Jackson’s dissent is attracting attention because of three memorable words:

Chaos. Uncertainty. Kafkaesque.

But strip away the rhetoric and her argument is straightforward.

The Supreme Court has allowed part of Trump’s election initiative to move forward without deciding whether the president ultimately possesses the authority to impose it.

States may challenge the policy again.

Federal regulations may be challenged separately.

Another injunction remains.

More litigation is coming.

And all of this is happening while election officials are preparing ballots and voters are preparing to cast them.

That is the part Americans should focus on.

Not whether Trump “won” Monday.

Not whether Jackson wrote an unusually sharp dissent.

Not which political team can turn the ruling into the best fundraising email.

The important question is whether the United States is approaching a congressional election without knowing precisely which election rules will survive judicial review.

Because democracies depend upon something extraordinarily basic:

Everybody needs to know the rules before the game begins.

And in the 2026 midterms, the game has already begun.

We the People deserve constitutional clarity before Americans start casting ballots—not after the votes have already been counted.

If You Found This Useful

Most political news tells you what happened.

We the People United! is about understanding what it means.

If you want independent analysis of the 2026 elections, the courts, the Trump administration, and the larger fight over American democracy—without reducing every issue to a cable-news shouting match—become a paid subscriber today.

Your subscription directly supports the research and writing that make deeper dives like this possible.

Already subscribed? Forward this post to someone who wants more than a headline.

P.S. ABC News and the Associated Press have also reported it. The conversation reportedly included housing, immigration and the cost of living, and the Los Angeles Times reported an additional detail that may be even more significant: Kushner suggested that Jeffries meet next with White House Chief of Staff Susie Wiles.

That sounds less like two old acquaintances having coffee and more like the beginnings of a communications channel.

And with the November 3 midterms barely ten weeks away, the timing matters.

This Meeting Is About More Than “Common Ground”

There is an innocent explanation for the conversation.

Jeffries and Kushner have worked together before. During Trump’s first administration, they were involved in negotiations surrounding criminal-justice reform. Political leaders are supposed to talk to people with whom they disagree, and Democrats will have to deal with the Trump administration regardless of which party controls Congress.

That argument deserves to be taken seriously.

But politics is also about incentives.

Kushner does not hold a formal White House position, yet multiple outlets describe him as a continuing outside adviser to Trump. And Jeffries is not simply another Democratic congressman. If Democrats capture the House, Hakeem Jeffries is overwhelmingly positioned to become Speaker.

Which changes the significance of the meeting considerably.

The conversation may therefore be both things at once: an attempt to find legitimate areas of cooperation and political contingency planning for a government in which Trump can no longer depend on a Republican-controlled House.

That distinction matters.

Because elsewhere in today’s news, Republicans are behaving like a party that knows November could go badly.

The Other Stories Today Tell the Same Story

Reuters reported Monday that Republicans are turning their September convention in Dallas into what amounts to both a rally and a rescue mission, as GOP strategists confront voter frustration over the economy, the Iran war and Trump’s political standing heading into the midterms.

The Wall Street Journal, meanwhile, highlighted Virginia’s 2nd Congressional District as one of the races that could determine control of the House. Republicans currently hold only a narrow 219–212 advantage, and the broader political environment includes dissatisfaction over prices, tariffs, energy costs and the economy.

Even the Cook Political Report’s current House ratings illustrate how little room Republicans have for error. As of its August 13 update, Cook classified 205 seats as Solid/Likely/Lean Democratic and 211 as Solid/Likely/Lean Republican — leaving the remaining seats in the genuinely competitive territory where control of the chamber will be decided.

In other words, Kushner did not reach out to Jeffries in a political vacuum.

He did it while the House majority is very much in play.

Paid subscribers get the full breakdown: why Susie Wiles matters, what a Speaker Jeffries would mean for Trump, the Democratic backlash to the meeting, and why cooperation and aggressive oversight could be happening simultaneously.

The Detail I Would Watch Most Closely

The most revealing part of this story may not be the Jeffries-Kushner meeting itself.

It is the reported suggestion that Jeffries speak with Susie Wiles.

Kushner can plausibly be described as an informal intermediary. Wiles cannot. She is Trump’s White House chief of staff.

If that follow-up happens, the significance changes.

It would indicate that people around Trump are not merely maintaining personal relationships. They would be establishing a working relationship with the man who could soon control one chamber of Congress.

That does not prove the White House expects Republicans to lose.

But it is exactly the kind of relationship-building a rational administration would undertake if losing the House had become a serious possibility.

And there is another clue.

Trump himself has recently changed his rhetoric toward Jeffries.

ABC reported that after years of personally attacking the Democratic leader, Trump told Punchbowl News this month that Jeffries was a “nice guy” and suggested that the two could get along.

Maybe Trump suddenly discovered bipartisan statesmanship.

Or maybe political reality has a way of creating newfound respect.

Democrats Have Reason to Be Suspicious

The meeting has also created genuine discomfort on the Democratic side.

TIME and The Guardian reported Monday that some Democrats and Trump critics questioned why Jeffries would privately engage with Kushner, particularly given continuing scrutiny surrounding Kushner’s business interests and his influence inside Trump’s orbit.

That skepticism is understandable.

If Democrats retake the House, Jeffries will face competing responsibilities that will be difficult to reconcile.

A Democratic House will be expected to legislate where legislation is possible.

It will also be expected to conduct serious congressional oversight.

Those responsibilities are not mutually exclusive.

Congress can negotiate a housing bill on Tuesday and issue subpoenas on Wednesday.

In fact, another recent Wall Street Journal report says Democrats are already preparing potential investigations involving Trump and his allies if they win the House, including questions surrounding business dealings, immigration enforcement, the Iran conflict and possible conflicts involving Trump-family financial interests.

That is why portraying the Kushner meeting as either capitulation or bipartisan harmony is premature.

It could be neither.

It could simply be preparation for divided government.

Housing, Immigration and Affordability Were Not Random Choices

Look closely at the three subjects reportedly discussed:

Housing. Immigration. Cost of living.

Those are not ceremonial bipartisan issues.

They sit close to the center of the 2026 election.

Affordability is especially important.

Republicans regained power promising voters relief from high prices. Now Democrats are trying to make the midterms a referendum on whether those promises were delivered.

That political vulnerability is showing up far beyond Washington.

In Colorado’s competitive 8th Congressional District, for example, Democratic challenger Manny Rutinel is explicitly building his campaign around affordability and the financial pressures facing working families.

Reuters reports similar Republican anxiety nationally, with economic dissatisfaction becoming one of the reasons GOP leaders hope their September convention can reset the political environment.

So when Kushner and Jeffries discuss the cost of living, they are discussing an issue that may help determine who controls Congress.

But Democrats Should Learn From the Past

There is a temptation whenever Democrats regain power after a period of Republican excess to prove that they are the adults in the room.

Sometimes that instinct produces important legislation.

Sometimes it produces unilateral disarmament.

Jeffries should absolutely speak with the White House if there is an opportunity to lower housing costs, improve immigration policy or provide meaningful economic relief.

But cooperation should be judged by results, not photographs, private dinners or declarations of bipartisanship.

Sen. Chris Van Hollen made essentially that distinction when discussing the meeting Sunday: talking is one thing; producing something meaningful is another.

That is the correct standard.

If the Trump administration wants Democratic votes for serious housing legislation, negotiate.

If it wants a workable immigration agreement that respects both border security and constitutional protections, negotiate.

If it wants legislation that materially lowers costs for ordinary Americans, negotiate.

But congressional oversight is not something to be traded away in return.

The Constitution did not create oversight as a partisan weapon. It created a legislature capable of checking executive power.

A Speaker Jeffries Would Change Washington Overnight

This is the part of the story that deserves more attention.

If Democrats win the House, Jeffries would not simply receive a nicer office.

The institutional balance of power would change.

A Democratic House would control committees.

Committee chairs.

Hearing schedules.

Investigative priorities.

Subpoenas.

Appropriations negotiations.

And the legislative calendar of the House of Representatives.

Trump would still be president. Republicans could still control the Senate. The administration would retain enormous executive authority.

But the era of a Republican House routinely protecting the administration from sustained congressional scrutiny would be over.

That is why the battle for the House is not merely another midterm scoreboard.

It determines whether Trump spends the final two years of his presidency dealing with a Congress partially controlled by his own party — or with Speaker Hakeem Jeffries sitting across the negotiating table.

Seen through that lens, Jared Kushner’s meeting suddenly makes considerably more sense.

The Democratic Challenge: Govern and Investigate

If Democrats win, they should resist two equally bad approaches.

The first would be spending two years doing nothing but investigating Trump.

The second would be becoming so obsessed with proving their bipartisan credentials that they fail to exercise meaningful oversight.

There is a third path.

Do both jobs.

Investigate legitimate allegations of misconduct.

Defend congressional authority.

Protect constitutional checks and balances.

And simultaneously put bills dealing with housing, healthcare, wages and affordability in front of the president.

Make the administration choose.

If Trump signs legislation that helps Americans, Americans benefit.

If he refuses, voters can judge the decision.

That is what functioning divided government is supposed to look like.

What This Meeting Really Tells Us

We should be careful not to claim more than the evidence supports.

There is no proof that Jared Kushner walked into that New York meeting believing Republicans have already lost the House.

There is no evidence that Jeffries promised Trump anything.

There is no evidence of some secret grand bargain.

What we do know is more interesting.

A politically connected Trump confidant met privately with the Democrat most likely to become Speaker.

They discussed issues on which a future divided government might have to negotiate.

Kushner reportedly encouraged Jeffries to establish contact with Trump’s chief of staff.

Trump has simultaneously softened his public language toward Jeffries.

And all of this is happening while Republicans confront a highly competitive House battlefield and growing concern about the midterm environment.

Those facts do not prove Republicans expect defeat.

They prove something almost as important:

They are taking the possibility seriously.

How We Fight Back

Keep the election focused on measurable results. Voters should ask whether their housing, healthcare, grocery and energy costs are actually improving.

Demand congressional accountability regardless of party. A legislature unwilling to oversee executive power is not performing its constitutional function.

Support genuine bipartisan legislation without confusing cooperation with surrender. Working across the aisle is valuable when it produces something worthwhile.

Pay attention to the House races that receive little national coverage. A handful of competitive districts may determine who controls the investigative and legislative machinery of the House.

Reject political tribalism that treats conversation itself as betrayal. Democracy requires negotiation. It also requires boundaries, accountability and transparency.

Final Word

Maybe Jared Kushner and Hakeem Jeffries really were just catching up.

Maybe they were exploring whether housing or affordability legislation might survive the partisan warfare of Washington.

But powerful political figures rarely spend their time preparing for circumstances they consider impossible.

The more revealing question, then, is not:

Why would Hakeem Jeffries meet Jared Kushner?

It is:

Why does Jared Kushner suddenly believe having a working relationship with Hakeem Jeffries might be important?

November may provide the answer.

If you value independent political analysis that connects the headline to the larger democratic stakes, become a paid subscriber.
